11. Viruses/malware/data security

While we use commercially provided antivirus software and endeavour to ensure that any files originating from our website or via email correspondence or any other communications with us are free of computer viruses, we make no warranty or guarantee that files are virus free.

Recipients must check all e-mails, attachments and other files before accessing them, and any and all risk of virus contamination is the full responsibility of the recipient.

Furthermore, while we take precautions to ensure the safety of our site, we cannot guarantee the security of any information you supply to us.

If you choose to communicate us with via WeChat or email or any other means, we cannot guarantee the security of those methods and the customer does so at their own risk.

12.    Limited Warranty

Clear and Concise’s services aim to reduce the number of errors in the text that you submit to us. Although we will endeavour to return your document to you free of any errors it is likely that it will not be possible for us to remove every error. By ordering Clear and Concise’s services you acknowledge that proofreading is not only subjective in nature but also that our editors may miss or form errors and there may be disagreement between Clear and Concise and the customer over the validity of particular changes we recommend to the customer’s writing.

You accept full responsibility for the use of any version of your document for any purpose (e.g. publishing, submitting, printing etc.). This includes, but is not limited to, any financial, brand and other consequences of those errors. Any changes we make to your writing are proposals. You must take full responsibility for accepting or rejecting any of the changes. You can do so by using the same 'Track Changes' function in MS Word that we will use to propose the changes.

13.    Limitation of Liability

Clear and Concise will under no circumstance be liable for indirect, special, or consequential damages including any loss of business, revenue, customers, or data in relation to your use of the Website or any material returned by us. Nothing within this Agreement will operate to exclude any liability for death or personal injury arising as result of the negligence of Clear and Concise, its staff or agents.

If you are dissatisfied with any Clear and Concise material, or with any of our terms and conditions, your sole solution is to discontinue using our services. In some circumstances, a full refund or a partial refund may be offered but this is at our sole discretion.

14.    Academic Liability

Each customer remains solely responsible both for ensuring any changes which they accept based on our recommendations accord with their institutional guidelines, for the grade awarded to their work or whether their article achieves publication. Clear and Concise is not able to guarantee that its services will ensure you attain a particular mark for your work. We cannot be held legally or otherwise responsible for disappointing and/or unsatisfactory outcomes of any factor, including the negligence of our editors, staff, or claims of such negligence.

15.    Use of the term ‘guarantee’ or ‘guaranteed’ and their Chinese language equivalents

Use of the term ‘guarantee’ or ‘guaranteed’ on this website or in communications with Clear and Concise refers to our assurances to deliver certain standards of service based on our own internal evaluations. Our ‘guarantee’, should we decide that we have failed to meet these standards, may be the sum of a partial or full refund at our discretion of the original amount paid by the client to engage one of our services. Not under any circumstances will the refund of monies be in excess of the original fee paid for the service. Refunds and partial refunds are entirely at our discretion.

16.    Plagiarism and Copyright Infringement

You must acknowledge that it is your sole responsibility to ensure that your work does not breach anti-plagiarism or copyright guidelines. We take no responsibility for ensuring any writing we amend on your behalf adheres to your individual university’s guidelines. It is your responsibility to satisfy yourself that any document you submit, including ones where our editors have suggested proposed amendments, do not breach anti-plagiarism or copyright guidelines.

17.    Purchases/Payments

Payment is to be received in full before any work will commence. Your completed work will be returned to you electronically via e-mail only. It is your responsibility to ensure that you provide correct contact details so that we can return your work by email.

18.    Order completion times/delivery times of service

We reserve the right to extend order turnaround deadlines if the editor believes that the document in question requires ‘above average’ amendments which will require greater time to complete.

In ordering this service you acknowledge that, in rare instances, an order may be delivered later than the scheduled delivery time (also listed as the "service speed", “return time” or “turnaround time” and their Chinese language equivalents). In such circumstances, we may offer a partial or full refund, but we accept no responsibility for any damages or losses incurred due to a late delivery of your order. We accept no liability for failure to deliver as estimated but may offer a partial or full refund in such instances at our discretion.

Whilst we fully endeavour to meet our stated turnaround times, in some instances this will not be achieved due to various factors that include but are not limited to technical failures or personal issues on the part of the working editor. In such instances we may offer a partial or full refund at our discretion, which represents our ‘guarantee’. We accept no liability for failure to deliver as estimated.

19.    Refunds

Refunds and partial refunds in certain circumstances may be offered at our sole discretion.

If you are not entirely satisfied with good reason, contact editor@clearandconcise.co.uk and refunds, or partial refunds, may be given when a reasonable reason for disappointment is cited.

We reserve the right to be given an opportunity to address any issues you have raised first before any refund will be offered.

20. Entire Agreement

These Terms, including any legal notices and disclaimers contained on this Website, constitute the entire agreement between Clear and Concise and you in relation to your use of this Website, and supersede all prior agreements and understandings with respect to the same.

21. Governing Law & Jurisdiction

These Terms will be governed by and construed in accordance with the laws of the UK and you submit to the non-exclusive jurisdiction of UK courts for the resolution of any disputes.
